The process

The SSDI process can be challenging, but with the Victory team by your side, you can be sure you’re getting expert support every step of the way.

Initial

The first step of the process is submitting an initial application for SSI and/or SSDI benefits. You can do this on your own, but our team is happy to help you fill out the application and forms. After you apply, it usually takes the Social Security Administration (SSA) three to six months to process your request.

Reconsideration

If your initial application is denied, you could have the option to appeal and enter the Reconsideration stage. During this time, the SSA reviews your case and may gather additional records if you provide them. This process usually takes one to five months.

Hearing

If your Reconsideration is denied, the next step is the hearing stage. After you request a hearing, you’ll typically wait 18 to 24 months. The SSA will notify you of the date and location about four to six weeks before the hearing. Meanwhile, our team will collect evidence and help you prepare.

Decision

Some judges make a decision at the hearing, while others take six to eight weeks. Regardless, you’ll receive a written decision explaining the outcome. If you’re approved, the process of starting your payments begins. Monthly benefits usually start within six to 12 weeks, and backpay may take a bit longer.

What Is SSDI? +

Social Security Disability Insurance (SSDI) is a Social Security program that benefits individuals who become disabled before reaching retirement age. This specific program is based upon an individual’s capacity for gainful employment.

What Is SSI? +

Supplemental Security Income (SSI) is a Social Security program that is strictly need-based. This program is not related to work history, rather, takes into consideration an individual’s income and assets. In some cases claimants can receive both SSDI & SSI.

Can I collect both Social Security Disability and VA Service Connected benefits? +

Yes. VA disability benefits are awarded to those who actively served in the military and were discharged on any grounds except dishonorable. The Social Security Disability program is based upon an individual’s capacity for gainful employment. As long as you meet the requirements for Social Security Disability Insurance (SSDI), you are eligible for both programs.

I already receive benefits from the VA, can I still receive Social Security Disability? +

Yes. There is no offset between VA service connected benefits and SSDI benefits.

I applied for disability benefits through Social Security and was denied, what is the point in trying again? +

Most first time applicants are denied when applying for Social Security Disability benefits. In fact, statistics tend to show that 75% of those applying on their own are denied by Social Security. If you have applied and been denied, the most important thing to do is to appeal the decision. Although there is a substantial amount of paperwork associated with filing an appeal, you can hire a Disability Attorney to assist you at no out of pocket cost.

How long does the process take? +

Claims can range from 3 months to over 3 years to be adjudicated. If you are a military Veteran who served after 2001, you may qualify for expedited processing through Social Security’s “Wounded Warrior” program.
